Terms of Service

These Terms of Service ("Terms") govern your use of the DawaHQ platform provided by DawaHQ Limited ("we", "us", or "DawaHQ", RC 9448673, Nigeria). By registering for or using DawaHQ, you agree to these Terms.
1. The Service
DawaHQ is a cloud-based healthcare management software-as-a-service (SaaS) platform that enables hospitals, pharmacies, diagnostic laboratories, and dental practices to manage patient records, appointments, billing, pharmacy operations, and related functions.
2. Account Registration
To use DawaHQ, your hospital must submit an onboarding application and receive approval from DawaHQ. You agree to provide accurate information during registration and to keep your account credentials secure. You are responsible for all activity under your account.
3. Subscriptions and Payment
DawaHQ is offered on subscription plans (Starter, Professional, Enterprise) billed monthly. Payments are processed via Paystack. All prices are in Nigerian Naira (NGN) unless otherwise stated.
Subscription fees are non-refundable except as set out in our Refund Policy. Failure to pay may result in suspension or termination of your account.
We reserve the right to update pricing with 30 days' written notice. Continued use after the notice period constitutes acceptance of new pricing.
4. Evaluation Period
Qualifying clinics may receive a complimentary evaluation period via a DawaHQ license code. License codes are issued at DawaHQ's discretion and grant access to the platform for the duration specified by the code type. At the end of the evaluation period, your account will be suspended unless you subscribe to a paid plan. Your data is retained for 30 days post-evaluation.
5. Acceptable Use
You agree not to:
- Use DawaHQ for any unlawful purpose or in violation of any applicable law or regulation
- Upload false, inaccurate, or misleading patient information
- Share your account credentials with unauthorised individuals
- Attempt to reverse-engineer, hack, or disrupt the platform
- Use DawaHQ to store or transmit malicious code
- Misuse the platform in ways that could harm other hospitals or patients
6. Data Ownership
Your hospital owns all patient data entered into DawaHQ. DawaHQ acts as a data processor on your behalf. You grant DawaHQ a limited licence to process data solely to provide the Service. See our Privacy Policy for full details.
7. Service Availability
DawaHQ targets 99.9% monthly uptime for Enterprise plans and best-effort availability for Starter and Professional plans. Scheduled maintenance will be notified at least 24 hours in advance. See our Service Level Agreement for full terms.
8. Intellectual Property
DawaHQ and all related software, designs, and content are the intellectual property of DawaHQ Limited. You receive a limited, non-exclusive, non-transferable licence to use the platform during your subscription.
9. Limitation of Liability
To the maximum extent permitted by law, DawaHQ shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability to you shall not exceed the amount paid by you in the three months preceding the claim.
10. Termination
Either party may terminate the subscription at any time. Upon termination, your access will cease at the end of the current billing period. Data will be retained for 30 days post-termination, after which it will be permanently deleted.
DawaHQ may suspend or terminate accounts immediately for violation of these Terms, non-payment, or conduct that harms the platform or other users.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved through arbitration in Nigeria, unless both parties agree otherwise.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email with 14 days' notice. Continued use of DawaHQ after this period constitutes acceptance.
